Purpose<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose of these General Terms and Conditions is to define the terms and conditions of sale of the services offered by Life Smart Home, in particular :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>New home construction<\/li>\n\n\n\n<li>Renovation work<\/li>\n\n\n\n<li>Installation of home automation solutions<\/li>\n\n\n\n<li>Site supervision and personalized support<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">All orders imply unreserved acceptance of these terms and conditions.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">2. Quotation and order<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">2.1 Request for quotation<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">All requests for services are subject to a <strong>free personalized quotation<\/strong>. This quotation specifies :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The nature of the work<\/li>\n\n\n\n<li>Provisional schedule<\/li>\n\n\n\n<li>Amount before and after tax<\/li>\n\n\n\n<li>Terms of payment<\/li>\n\n\n\n<li>Quotation validity period (usually 30 days)<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">2.2 Acceptance<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The order is considered firm once the quotation has been signed by the customer with the words \"Bon pour accord\" (\"Good for agreement\") and a deposit has been paid (unless otherwise specified). The signature constitutes validation of the GCS.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">3. Rates and payment terms<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">3.1 Pricing<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Prices are expressed in <strong>Moroccan dirhams (MAD)<\/strong> or in <strong>euros (EUR)<\/strong> depending on the target market.<br>They are indicated <strong>before tax (HT)<\/strong> and <strong>all taxes included<\/strong> in accordance with current legislation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3.2 Payment<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Unless otherwise indicated on the quotation :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>30 % on order (deposit)<\/li>\n\n\n\n<li>40 % in progress<\/li>\n\n\n\n<li>30 % on completion of work (or delivery)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Payments may be made by bank transfer, cash or other means agreed between the parties.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">4. Turnaround times<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The lead times indicated on the quotation are for guidance only.<br>Any modification to the project, delay in validation, bad weather or force majeure may have an impact on these deadlines, without the Service Provider being held liable.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5. Customer's obligations<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Customer undertakes to :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Provide accurate and complete information about your project<\/li>\n\n\n\n<li>Give access to the site for interventions<\/li>\n\n\n\n<li>Respect agreed payment terms<\/li>\n\n\n\n<li>Report any changes or problems as soon as possible<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">6. Reservation of ownership<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Service Provider retains ownership of the goods delivered (home automation equipment, materials, etc.) until full payment has been received.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">7. Warranty and liability<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">7.1 Warranty<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Our services are covered by <strong>legal warranties<\/strong> in force, including :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Completion guarantee<\/li>\n\n\n\n<li>Biennial warranty<\/li>\n\n\n\n<li>Ten-year warranty (for structural work)<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">7.2 Limitation of liability<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Life Smart Home cannot be held responsible for indirect damage, delays caused by third parties, or failure to meet deadlines due to external circumstances (acts of God, force majeure, administrative decisions, etc.).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">8. Claims and disputes<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">All complaints must be submitted in writing within <strong>7 days after acceptance of work<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of a dispute, we will endeavor to resolve it amicably.<br>Failing this, the dispute may be brought before the competent courts of <strong>Marrakech <\/strong>depending on the location of the contract.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">9. Applicable law<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These General Terms and Conditions are governed by <strong>Moroccan law<\/strong> or the <strong>French law<\/strong> according to the place of performance of the contract. In case of doubt, the French version shall prevail.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">10. Personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Data collected in the context of a project is processed in accordance with our <a href=\"https:\/\/life-smarthome.com\/en\/politique-de-confidentialte\/\">Privacy policy<\/a>.<br>The customer has a right of access, rectification and opposition.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">11. Objet Les pr\u00e9sentes CGV ont pour objet de d\u00e9finir les modalit\u00e9s de vente des prestations propos\u00e9es par Life Smart Home, notamment : Toute commande implique l\u2019acceptation sans r\u00e9serve des pr\u00e9sentes CGV. 2. Devis et commande 2.1 Demande de devis Toute demande de prestation fait l\u2019objet d\u2019un devis gratuit et personnalis\u00e9. Ce devis pr\u00e9cise : 2.2 Acceptation La commande est r\u00e9put\u00e9e ferme d\u00e8s signature du devis par le Client avec la mention \u00ab Bon pour accord \u00bb et le versement d\u2019un acompte (sauf indication contraire). La signature vaut validation des CGV. 3. Tarifs et modalit\u00e9s de paiement 3.1 Tarification Les prix sont exprim\u00e9s en dirhams marocains (MAD) ou en euros (EUR) selon le march\u00e9 cibl\u00e9.Ils sont indiqu\u00e9s hors taxes (HT) et toutes taxes comprises (TTC) selon la l\u00e9gislation en vigueur. 3.2 Paiement Sauf indication contraire sur le devis : Les paiements peuvent \u00eatre effectu\u00e9s par virement bancaire, esp\u00e8ces ou autre moyen convenu entre les parties. 4. D\u00e9lais d\u2019ex\u00e9cution Les d\u00e9lais d\u2019ex\u00e9cution indiqu\u00e9s sur le devis sont donn\u00e9s \u00e0 titre indicatif.Toute modification du projet, retard de validation, intemp\u00e9ries ou force majeure peuvent impacter ces d\u00e9lais sans que la responsabilit\u00e9 du Prestataire soit engag\u00e9e. 5. Obligations du client Le Client s\u2019engage \u00e0 : 6. R\u00e9serve de propri\u00e9t\u00e9 Le Prestataire reste propri\u00e9taire des biens livr\u00e9s (\u00e9quipements domotiques, mat\u00e9riaux, etc.) jusqu\u2019au paiement int\u00e9gral du prix. 7. Garantie et responsabilit\u00e9 7.1 Garantie Nos prestations sont couvertes par les garanties l\u00e9gales en vigueur, notamment : 7.2 Limitation de responsabilit\u00e9 Life Smart Home ne saurait \u00eatre tenu responsable des dommages indirects, retards li\u00e9s \u00e0 des tiers, ou non-respect des d\u00e9lais dus \u00e0 des circonstances ext\u00e9rieures (cas fortuit, force majeure, d\u00e9cisions administratives\u2026). 8. R\u00e9clamation et litige Toute r\u00e9clamation doit \u00eatre adress\u00e9e par \u00e9crit dans un d\u00e9lai de 7 jours apr\u00e8s r\u00e9ception des travaux. En cas de litige, une tentative de r\u00e9solution amiable sera privil\u00e9gi\u00e9e.\u00c0 d\u00e9faut, le litige pourra \u00eatre port\u00e9 devant les tribunaux comp\u00e9tents de Marrakech , selon la localisation du contrat. 9. Droit applicable Les pr\u00e9sentes CGV sont r\u00e9gies par le droit marocain ou le droit fran\u00e7ais selon le lieu d\u2019ex\u00e9cution du contrat. En cas de doute, la version fran\u00e7aise pr\u00e9vaut. 10. Donn\u00e9es personnelles Les donn\u00e9es collect\u00e9es dans le cadre d\u2019un projet sont trait\u00e9es conform\u00e9ment \u00e0 notre Politique de confidentialit\u00e9.Le Client dispose d\u2019un droit d\u2019acc\u00e8s, de rectification et d\u2019opposition. 11.
